Stop Trading on Congressional Knowledge Act of 2012 (STOCK Act)


The STOCK Act established significant new requirements for the Office of Government Ethics, the executive branch ethics program, ethics officials, and federal officials who file public financial disclosure reports pursuant to the Ethics in Government Act, among other changes. On March 28, 2013, in accordance with section 2 of Public Law 112-178, the National Academy of Public Administration (NAPA) submitted an independent study on the impact of the STOCK Act to Congress and the President of the United States. On April 5, 2013, the Director of the U.S. Office of Government Ethics sent a letter to congressional leadership concurring with the NAPA study recommendations to indefinitely suspend a STOCK Act provision that would require online posting of the personal financial data of approximately 28,000 federal employees. STOCK Act Legislation

Bill amending the STOCK Act to limit the online posting requirement for public financial disclosure reports, S. 716, signed into law on April 15, 2013, Public Law 113-7. (PDF) S.716, among other things, limits the STOCK Act's online posting requirement of public financial disclosure reports to the President, the Vice President, and any officer occupying a position at Levels I and II of the Executive Schedule as defined by 5 U.S.C. 5312 and 5313. The bill also extends the date by which OGE must develop an e-filing system to January 1, 2014 and eliminates the requirement that the system allow for the searching, sorting and downloading of data contained in the reports.

Bill amending the STOCK Act to extend the December 8th Posting Deadline to April 15, 2013, H.R. 6634, signed into law on December 7, 2012, Public Law 112-207. (PDF) H.R. 6634 extends the date by which certain executive branch public financial disclosure forms must be made available on the internet to April 15, 2013.

Bill amending the STOCK Act to extend the September 30th Posting Deadline to December 8th, S. 3625, signed into law on September 28, 2012, Public Law 112-178. (PDF) S. 3625 extends the date by which most executive branch public financial disclosure forms must be made available on the internet to December 8, 2012. The bill also requires executive branch officials to submit periodic transaction reports for their spouses and dependent children, effective January 1, 2013.

Bill amending the STOCK Act to extend the August 31st Posting Deadline to September 30th, S. 3510, signed into law on August 16, 2012, Public Law-112-173. (PDF) S. 3510 extends the date by which executive branch public financial disclosure forms must be made available on the internet to September 30, 2012.
